DELTA DEL RIO DAGUA PORT SOCIETY S.A.

From the issuance of Law 01 from 1991, five Port Expansion Plans have been issued by CONPES, aimed at developing a system of the sector.

Sociedad Portuaria Delta del Río Dagua S.A. (SPDRD SA) was constituted through Public Deed No. 3347 of the First Notary Office of Buenaventura, registered at the Chamber of Commerce of Buenaventura with No. 0653, Book 9, of November 11, 1997.

CONPES DOCUMENT 2992 is issued, establishing the "Port Expansion Plan 1998-1999". The layout clearly showed the need to plan the construction and set in a short term period of time, the operation of a cargo dock, giving birth to the proposal of Terminal Marítimo Delta del Río Dagua.

On December 20, CONPES DOCUMENT 3149 "Change to Build Peace"- Port Expansion Plan 2002-2003 is issued, in which the Project Terminal Marítimo Delta del Río Dagua appears as one of the private investments to be promoted.

On March 14, CONPES DOCUMENT 3342 is issued, by which the Port Expansion Plan 2005-2006 "Strategies for the competitivity of the Port Sector" is established. In May 23, CONPES DOCUMENT 3355 is issued, clarifying CONPES DOCUMENT 3242.

SPDRD SA works in the engineering of Terminal Marítimo Delta del Río Dagua and the preliminary designs on the same, the plotting of the access road and the bridge over the Dagua River are made. Construction budget is made.

The Technical and Financial Feasibility Analysis are completed, and Notices of Intention to Grant Application are published, on May 22 and 23 and June 6 and 7; within two months of the publication no opposition or an alternative reference was made.

On April 22, Communication 6961 was filed at the National Institute of Concessions (INCO), by which a port concession was requested to occupy temporarily and exclusive an area for public use made up of low tide ground in front of the maritime access channel to

the bay of Buenaventura, to build, manage and operate port facilities for public service for the handling of general, containers and bulk solids cargo for a period of thirty years.

On August 14, INCO ordered by Resolution 421, the holding of the Public Hearing referred to in Article 11 of Decree 838 of 1992, which took place on 25 August.

On May 26, SPDRD SA brings the Insurance Policy issued by the Condor Insurance Company SA, guaranteeing the seriousness of the proposal submitted in the request for Port Concession.

On October 7, the First Section, Chamber of the Contentious Administrative of the State Council, notified INCO, that the fundamental right to due process of the Sociedad Portuaria Delta del Río Dagua S.A. is mentored. On November 19, Inco issued Resolution 488, "Whereby the terms

that a port concession may be granted to Sociedad Portuaria Delta del Río Dagua S.A. are indicated"

Eleven of the fourteen clarifications requested in Resolution 488 are to INCO. Procedures are done to start the Subtraction of Area for the Pacific Forest Reserve of the TMD and its access road, the obtaining of the Environmental License and to guarantee

the constitutional rights of the Afro-Colombian communities - black, "palenqueras" and "raizales"- in the Area of Direct Influence of the Terminal Marítimo Delta del Río Dagua. With this, the fourteen requirements of the Resolution will be completed.

Fieldwork for the Environmental Impact Assessment starts in conjunction with the Communities certified in the area of direct influence by the Ministry of Interior. Accompanying Agreement by this these communities is signed. On September 24, an extension

of time is obtained, to complete the requirements requested in resolution 488 of November 19, 2010, until November 19, 2013, by Resolution No.538 of 2012.

On August30 the Environmental Diagnosis of Alternatives (DAA) is delivered to the National Environmental Authority Licenses (ANLA); this entity issues Order No. 1374, "Whereby an alternative for the project called Terminal Marítimo Delta del Río Dagua is defined".

On October 18 an extension of time is obtained to complete the requirements stipulated in Resolution 488 on November 19 2010, through November 19, 2014, by Resolution No.1145 of 2012.

The Environmental Impact Assessment (EIA) is delivered to ANLA on August 1. The Final Application for a Definitive Subtraction Area of Forest Reserve was filed before in the Ministry of Environment and Sustainable Development of, on

the same date who on September 11 issued Order No.325 "By means of which a final subtraction process starts Pacific Forest Reserve established by Law 2 of 1959". On July 29, the SPDRD SA provides the Insurance Policy issued by Segurexpo

Insurance Company, continuing guarantee the seriousness of the proposal submitted in the request for port concession.

On May 26, 27 and 28 Agreements with the three Communities present in the Direct Area of Influence of Terminal Marítimo Delta del Río Dagua are logged, Prior Consultation coordinated by the Interior Ministry with the participation of the ANLA.

On May 29, the Act of the ANLA Logging, along with the minutes of socialization signed by the representatives and participants of the three Communities: Guadualito, Campo Hermoso and Zacarías is delivered. On June 24, the ANLA issues the Order 2488,

"Whereby the Environmental Licensing process is initiated and other decisions are made". This authority constitutes the record and technical visit to the project area for 8, 9 and July 10, 2015 is programmed.

Willing to reach higher levels of marketing, Macro proyecto Delta del Río Dagua includes four port areas and an industrial zone, all of sustainable growth.

TMD
First project to build will have space for liquid bulk (Fuel).

COAL DOCK AND YARD
There will be 30 hectares of land to hold the yard.

FISHING PORT AND TUNA PROCESSING
It will give the community the opportunity to directly to the port, will also generate employment in the tuna processing plant and fishing sub-products.

TIMBER DOCK
A wood processing plant in order to export processed wood.

LIGHT INDUSTRY
There will be lots with the necessary infrastructure to allow national and international companies to settle and transform products.
